Can Restaurants Donate Leftover Food
Food waste is a problem around the world, and restaurants play a large role. Let’s see the legal ways businesses can donate unused food.
Each year, 40 million tons of food is wasted in the United States – thats over 25% of the total US food supply. With so many people going hungry across the country, it is often wondered if restaurants can help give away unused food. After all, estimates indicate that the food industry spends $162 billion every year in costs related to wasted food.
So, can restaurants donate leftover food?
Simply put, yes – restaurants can donate unused food. However, businesses must adhere to a few guidelines to ensure safety.
How To Donate Nonperishable Food Step By Step:
- Step 1: Research what food bank institutions are near you to find where to donate food.
- Step 2: Find out which food items can be donated to that specific food bank.
- Step 3: Gather up all of the items that you wish to donate, being sure to stick to the guidelines on the products and provided by your selected food bank.
- Step 4: Once you have gathered the food, check to make sure no expiration dates have passed.
- Step 5: Check out the packaging on each of the items. Do not send in any rusty or heavily dented cans, boxes that have been crushed, or anything that leaks.
- Step 6: Take the food to the designated address during the appropriate time.

Develop A Relationship With Local Food Banks
Organizations need donations, but they have policies and processes to follow. You usually cannot call up unannounced and expect to offload heaps of leftover food.
Make sure to contact several charitable organizations in your area to see what they need and how they accept donations. Some places may only want non-perishable items, while others may take produce and other goods.
To start, you can use Feeding Americas search tool to find food banks near you.

Are Canned Food Donations Tax Deductible
The short answer is yes. However, there are some rules you must follow to write off the value of your canned food donation on your tax return. The first thing youll want to confirm is that the place youre donating to is a tax-exempt organization. The IRS has a list of organizations on its website, which you can access using the Exempt Organization Search Tool.
You should be aware that not all tax-exempt non-profits will appear on the list. For example, any non-profit that is already tax-exempt will have an application on file. This includes churches, mosques, synagogues, and government agencies.

Why Arent Restaurants Donating More Food
Business owners need to worry about liability from all angles – slip and fall, working conditions, and food safety. With so many ongoing concerns, why would a business owner want to add another potential problem to their list of worries?
That being said, Nicole Civita, a professor and director of the Food Recovery Project with the University of Arkansas School of Law states there is no available public record of anyone in the United States being sued or having to pay damages because of harms related to donated food.
In fact, restaurants have legal protection when it comes to donating food. Businesses benefit from the Bill Emerson Good Samaritan Food Donation Act. As long as the donor does not act with negligence or intentional misconduct, the restaurant is not liable for damage incurred as the result of illness.

Can I Donate A Thanksgiving Turkey To A Food Bank
A common question we hear around Thanksgiving is, Where can I donate a turkey for Thanksgiving? We are always thrilled to hear folks are interested in supporting their local food banks efforts to brighten the holidays for neighbors facing hunger, but the reality is, donating a turkey is not the best way to do that. Unless your local food bank has asked explicitly for frozen turkey donations, consider another way to give back during Thanksgiving.
Why not all food banks accept turkey donations
Food safety
Feeding America takes food safety incredibly seriously. All the food distributed across the network of food banks, whether perishable or shelf-stable, has been appropriately checked and is safe to eat. Those same standards must be met by any food you donate, too.
When you donate a frozen turkey, theres no way to guarantee someone kept it at a safe temperature or that manufacturers followed proper food safety protocols. And because of that uncertainty, food banks may not want to risk distributing them.
Not enough storage
Turkeys are big. The average Thanksgiving turkey comes in at a total of 15 pounds! That means theyre not easy to store, especially because they require freezer space.
Just think about keeping a turkey in your own refrigerator. With all the other food you might buy for Thanksgiving stuffing, potatoes, collard greens, cranberry sauce it can get crowded in there fast.

If You Want To Make A Food Donation Give Nutritious Non
Your local food bank will likely accept almost any non-perishable food item, but here are the items that food banks want the most:
If youre donating canned goods, look for cans labeled low-sodium or no added salt.Too much sodium increases a persons risk for heart disease and stroke, and food insecure individuals may already be at higher risk. Also, stick to fruits and vegetables that are canned in water instead of syrup, or that are labeled no added sugar. As too much sugar increases a persons risk of type 2 diabetes, and makes it harder for people with type 2 diabetes to manage their blood sugar. And, again, people who are food insecure may already be at a higher risk.

Rescuing Food For Hungry Californians
Feeding hungry people with donations of extra food is an integral part of resource conservation. Organizations served by food rescue and food bank programs include community centers, soup kitchens, food pantries, homeless shelters, senior programs, and childcare centers.
- Food rescue means recovering healthy foods and making fast deliveries to those in need. This is the highest and best use for perishable food. The Fresno Metro Ministry Food Recovery project, which takes excess perishable food to hungry people, is an example.
- Food Finders is a community-based food rescue organization in Southern California, which serves as a conduit, between donors and people in need.
- Food rescue in Southern California also includes Waste Not OC Coalition which works to help meet the nutritional needs of the community by facilitating the donation and distribution of surplus food.
- Food banks are organizations that collect food from a variety of sources, and distribute it to hungry people through local service agencies. The California Association of Food Banks which has a membership of 43 food banks, is one of the leading organizations in California. Major programs include Farm to Family which works with growers and packers to provide fresh produce to banks.
