A: The tax credit is a refundable credit equal to 25% of the fair market value of qualified donations. Taxpayers are limited to maximum credit of $5,000 per year.
Example:An eligible farmer makes qualified donations during tax year 2018 that have a fair market value of $12,000. The eligible farmer would be allowed a credit of $3,000 calculated as follows: $12,000 X 25% = $3,000.
The fair market value of qualified donations is generally the market price of the donated crop, determined in accordance with current federal standards. The fair market value using these standards is determined:
- without regard to internal standards, lack of market or similar circumstances, or by reason of being produced by the taxpayer exclusively for the purposes of transferring the food to an eligible food pantry and

Food Bank For New York City is NYCs largest hunger-relief organization. We distribute food and resources through our network of nearly 1,000 food pantries, soup kitchens, schools, and other partners. More than 1.1 million New Yorkers were experiencing food insecurity before the pandemic and that number has only grown over the past year. Food Bank projects that nearly 1.6 million NYC residents will experience food insecurity in 2021 due to the economic fallout of COVID-19.People who had never set foot on a pantry line have now become regular clients. Essential workers, furloughed employees, single parents, and seniors have all turned to us to fill in food gaps for themselves and their families during this challenging time. More and more New Yorkers are depending on us to make ends meet, so were working to provide more resources to our member agencies on the ground and implement new strategies to fight hunger wherever it exists.

The month of November often conjures images of falling leaves, jackets and scarves, turkey, stuffing and all of the other fixings that come with Thanksgiving dinner.
But for many in the city, Thanksgiving is another reminder of what they dont have.
There are an estimated 1.4 million people in the city who rely on emergency food programs, like soup kitchens, to get by each year, according to the Food Bank of New York. Of those, about 339,000 are children.
There is no shortage of options when it comes to giving back to your community this holiday season. Food banks, soup kitchens and nonprofits in all five boroughs are accepting donations to feed the hungry.
Heres a list of places to get you started.
Located at 227 Bowery, the mission accepts food donations between 7 a.m. and 7 p.m., Monday through Saturday. The Bowery Mission serves more than 1,000 meals each day to low-income and homeless New Yorkers. In 2016, the organization also handed out 44,700 bags of groceries to those in need. The mission suggests donations that are nonperishable, but it can accept fresh prepared foods so long as the packaging hasnt been tampered with.

Q: Can A Farm Deliver Donations Through A Third Party Such As A Not
A: Donations made to a food pantry through a third-party IRC § 501 entity may qualify for the credit so long as the third-party nonprofit can provide the eligible farmer with a reasonable accounting of the donation and a receipt from the food pantry.

Giant Food is teaming up with Kellogg’s Company to support Marylanders in need. Giant Food will deliver a truck full of delicious cereals from Kellogg’s to the Maryland Food Bank in Baltimore, and both companies are donating $10,000 each to the food bank, for a total of $20,000. Representatives from both companies will then volunteer to sort and pack food for distribution through MFB’s statewide network of community partners.
The donation of food and funds are being made as part of Giant Food’s ‘Lend a Hand for Hunger’ program and their commitment to eliminate hunger and change children’s lives, as well as Kellogg’s Better DaysPromise, its global environment, social and governance strategy to advance sustainable and equitable access to food and create better days for 3 billion people by the end of 2030.

The Food Bank welcomes food donations from individuals and companies alike. If you would like to make a donation of food as an individual, you may drop it off weekdays between 8:00am and 4:00pm or make a cash donation online. The Regional Food Bank receives several hundred thousand pounds of donated food and non-food items each week from the food industry. No donation is too great or too small. Every donation plays a part in making it possible for the Food Bank to provide over 35 million pounds of food and grocery products each year for hungry and disadvantaged people. The Food Bank has the capacity to serve as your one-stop resource for making optimal use of unmarketable product, giving you the opportunity to conveniently reach several non-profit agencies with your donations.
Q: When Does The Tax Credit Program Start
A: The credit is effective for taxable years beginning on or after January 1, 2018. Donations made during the tax year may be claimed on the return for that tax year.
Example: A qualified donation is made on February 1, 2018. The farmer will claim a credit against that donation when he files his 2018 tax return. Donations made prior to January 1, 2018, will not be eligible for the credit.

The Food Bank accepts donations of shelf-stable, fresh and frozen food, and non-food items such as paper goods, personal hygiene products and cleaning supplies basically any item available from a grocery retailer or distributor. These products may no longer be marketable for the company, but if they are still good to use and can be safely consumed they are of great value to the non-profits the Food Bank serves.There are many reasons why companies choose to donate, including:
- Production flaws
- Unlabeled product
- Discontinuation of product line
- Code dates guidelines are researched and followed for safely utilizing close or past dated products
- Cosmetic packaging damages
- Deliveries that are not accepted and cannot be returned cost-effectively

What Is A Food Pantry
For some, a food pantry is a source of emergency assistance. For many, it is a supplement to low or fixed income, loss of income due to illness or job loss, or loss of second income for single parents. Food pantries help provide nutritious food to babies, children, seniors, veterans, and struggling families. Our member food pantries provide enough groceries for a minimum of 3 meals per day for at least 3 days for each person in the household.

Q: What Is Needed To Claim The Credit
A: In order to claim the credit, the taxpayer must receive and keep a receipt from the eligible food pantry showing the following:
- the name of the eligible food pantry,
- the EIN of the eligible food pantry,
- the date and location of the qualified donation, and
- a reasonably detailed description of the qualified donation.

A: Eligible donations include fresh fruits, vegetables, eggs, and meat products grown or produced in New York State. Donations of apparently wholesome food that meets all quality and labeling standards, even though the food may not be readily marketable due to appearance, age, freshness, grade, size, surplus, or other conditions, will qualify.

The award to the Town of Montgomery was made through the Community Development Block Grant CARES program administered by New York State Homes and Community Renewal. Due to the economic impact of the COVID-19 pandemic, the demand for food assistance across the Hudson Valley Region grew substantially and the Food Bank of the Hudson Valley outgrew its current facility.
The new distribution warehouse will provide increased capacity to obtain, store, and distribute food donations to 400 member agencies in six counties in the lower Hudson Valley: Orange, Ulster, Dutchess, Sullivan, and Putnam Counties. It is estimated that nearly 179,000 low- to moderate-income New Yorkers in the Hudson Valley are currently receiving food assistance.
