How Are The Tax Incentives Calculated

General tax deduction: Businesses that donate inventory may claim a tax deduction in the amount of the propertys basis, which is usually its cost to the business and is often lower than the fair market value, which is the value at which goods can be sold. Businesses other than C-corporations including S-corporations, sole proprietorships, and some LLCs cannot deduct more than 30% of the business total taxable income each year. C-corporations generally cannot deduct more than 10% of their taxable income for the year.

Enhanced tax deduction: The enhanced tax deduction provides an extra incentive for donation by allowing the donating business to deduct the lesser of twice the basis value of the donated food or the basis value of the donated food plus one-half of the foods expected profit margin . Under the enhanced deduction, all businesses may deduct up to 15% of their taxable income for food donations.

Example: A grocery store donates potatoes with a fair market value of $100. The basis value of these potatoes was $30. The expected profit margin is the fair market value minus the basis value , which is $70. Under the enhanced deduction, the grocery store is eligible to deduct the smaller of:

1. Basis Value x 2 = $30 x 2 =$60or

2. Basis Value + = $30 + = $65

The enhanced deduction would be $60, which is substantially higher than the general deduction .

You can write off food donations on your taxes only if you give the food to a qualified charity. Qualified charities typically include religious organizations, nonprofit charitable organizations and nonprofit hospitals. If youâre not sure if an organization qualifies, you can check the IRS online database. If you make the donation to a non-qualified organization or an individual, no matter how needy that person is, you canât write off the donation on your taxes. Naturally, you can also write off a cash donation you make to a charity to help it meet its food expenses or any other costs.

When you make a donation of food, you usually have to deduct only the price that you paid for it. You can only include gains on what you paid for it if the gain would be long-term capital gains, which means you have to hold the food for a year before donating it, which is probably unlikely. For example, if you find a really great sale on spaghetti so you can buy it for 25 cents per pound when it usually costs $1.50, unless you hold that spaghetti for a year, youâre limited to deducting 25 cents per pound.

Deductions For Charitable Donations

Since 1969, the general rule has been that taxpayers who have contributed appreciated inventory or other income property are allowed a charitable deduction for an amount equaling the taxpayers basis in the property and not its fair market price.

Contributions to charities can generally be deducted up to 50% of adjusted income, excluding net operating loss carrybacks. However, contributions to private foundations, veterans organizations, fraternal societies, and cemetery organizations are restricted to 30% of adjusted gross income, calculated without considering net operating loss carrybacks. These limitations are indicated by the Tax Exempt Organization Search using deductibility status codes.

You will need a receipt from your charity to document the donation. The receipt must include the name of the charity, the date, and your donation description. It should also indicate whether you were compensated for it.

Strategic Ways To Support Your Local Food Bank

Posted on by CanadaHelps

This blog post is written by Tamara Rahmani, Western Canada Charity Engagement Specialist at CanadaHelps.

As Canadians sit down to enjoy Thanksgiving dinner, thousands across the country and millions more around the world dont know where their next meal will come from. In fact, each month in Canada, there are over one million visits to food banks, and over a third of those helped are children. But despite the critical need for these organizations, food banks dont receive any direct government funding and rely almost entirely on community donations.

This, of course, means your help is essential, but there are some key things to consider if you are looking to effectively support your local food bank.

Take donating canned items for example, this practice stems back decades. Its simple, your office is holding a food drive or your childs school play requires one non-perishable good for admission and you raid the back of your pantry for the extra can of beans or creamed corn to give away. Although any food bank will generally welcome your donation of healthy, non-perishable foods, these items have a shallow rate of charitable return when it comes to making a big impact.

Canned goods aside, there are several other ways to make a contribution really count and effectively help a food bank support someone who may have to choose between feeding their family or making rent.

Donations From Previous Years

Food bank donations needed as demand rises

Since the CDTC is greater for donations higher than $200, it may be worthwhile to accumulate donations and claim them all together in the same year. There are two ways to accumulate donations: you can combine them with your spouse`s on a single tax return or you can claim donations from multiple years together in the same year. Donations can be carried forward for up to five years.

If you need to know if you have claimed donations in previous years, you can find out using the CRAs My Account online service. Once you log into your account, click on the tax returns tab at the top of the page. From there, you can view your tax returns from previous years. Look at line 349 on your previous T1 General tax return prior to 2019 or line 34900 of your Income Tax and Benefit returns of 2019 and onward to determine whether you have claimed donations for each of the past five years.

Charitable Donations Of Food Inventory

New more liberal rules for donating food inventory to charity are an opportunity that shouldnt be missed.

In the early years of the income tax, private philanthropy was encouraged by the inclusion of a charitable contribution deduction in the Internal Revenue Code. The original charitable contribution deduction was enacted in the War Revenue Act of 1917, P.L. 65-50. The present Code provides a deduction for charitable contributions made within the tax year ).

A corporation reporting taxable income on the accrual method is allowed to elect a charitable contribution deduction if the board of directors authorizes the contribution during the year and the contribution is made on or before the 15th day of the fourth month following the close of the year ).

Charitable contributions of food are given special treatment in the Code ). And a recent change in the law makes it easier for taxpayers to claim charitable deductions for food products donated to charity , P.L. 114-113).

Charitable deduction basics

No charitable deduction is allowed for the contribution of services, although unreimbursed expenditures made in the course of performing services for a charitable organization may constitute deductible contributions ).

Charitable deductions for food
